Docherty preliminary hearing set

A preliminary hearing has been set for Kenneth Allan Docherty, 35, in the stabbing death of a Kleinburg man in Orangeville last May.

Mr. Docherty has been in custody since his arrest on a charge of seconddegree murder the same day as the body of Tyson C. Weber was found in the garage of the home Mr. Docherty shared with his common-law spouse, Michelle Ballum, on Montgomery Blvd.

No information about the circumstances of the stabbing, or why Mr. Weber was in Orangeville, have come to light publicly since then.

Mr. Docherty has no known history of violence, and no reason has been forthcoming about why he has remained in custody for almost nine months.

He is represented by Orangeville defence lawyer Carrie Bellan, who initially said bail hearings were delayed because she had not received full disclosure from the Crown. At the time, the Crown said police had not completed their investigation.

The Ontario Court hearing, which is likely to be subject to a publication ban, will commence at 9:30 a.m. on Feb. 17.
