A comment regarding this issue, we can only wish that the police (but highly doubt) will be forthcoming in letting people in this situation know, that once the police seize their drivers license, they can immediately demand a second test from a different approved roadside screening device. And that only the result from the second test may be used in determining impairment. The officer must also keep a written record indicating the EXACT time the drivers license was seized.

There are side effects from this law that the McGuinty government didn't count on, police forums on the internet are already abuzz with the notions that the only reason the public will see a decrease in CCC. Over .80 charges drop, is because it will be cheaper and less time consuming for both the police and the courts to lay charges under this new law and not the CCC. and there is no possible means for a person, even the really innocent ones, to fight the charges. I don't blame them for their way of thinking, do I spend countless hours doing paperwork and attending court where's there's a very good chance the person will be found not guilty based on my weak evidence, or do I take the easy way out and can be at Timmie's in an hour for a donut?

The police and their bed partners MADD have always complained that too many DUI

charges were being thrown out and low conviction rates due to technicalities in the law which were implemented to preserve the proper notion that a person is innocent until proven guilty. Well, as a citizen (and a non drinker I might add) I find it a little ludicrous that our government is acting like spoiled rich kids playing a game, they figured out that playing by the rules (current law) they couldn't win every time, so they throw a hissy fit and just change the rules to their advantage so ONLY they can win. There are already lawyers drooling over this newly enacted draconian law. Only in Canada can the police be judge, jury and executioners right on the roadside.
