ELGV awaits explosives decision
Following a full day of arguments last Thursday in Superior Court at Kitchener, Justice Jane Milanetti has reserved her decision on whether to issue an injunction for Orica to continue operating its explosives facility in Dufferin pending the outcome of an Ontario Municipal Board hearing.
The facility is near Luther Marsh in East Luther Grand Valley. Temporary zoning, in place for Orica since 2007 and for other operators for more than 10 years before that, expired on June 12 at the same time as a federal explosives license was due for renewal.
The motion before the court was for Orica to obtain an interlocutory injunction against the township's denial of a renewal of the temporary zoning.
In an initial hearing before the same court earlier, a temporary injunction was issued barring the township from prohibiting the operation of the explosives plant until such time as all arguments on the motion had been heard and a final decision rendered.
Last week's hearing was the continuation. According to the rules, the earlier decision remains in place at least until such time as Judge Milanetti issues her decision.
ELGV lawyer Stephen D'Agostino said it would be inappropriate for him to comment on the hearing while the ruling was on reserve, and Orica lawyer John Docherty could not be reached for comment.
