Docherty trial may end next week

After more than 50 exhibits and numerous Crown witnesses, the second degree murder trial of Kenneth Docherty could go to the jury as early as next week.

The prosecution is expected to conclude its evidence this week, and at press time it wasn’t clear whether defence lawyer Carrie Bellan would call any evidence.

Among exhibits this week, the Crown produced diagrams of the death scene of May 29, 2008, along with photographs of the house on Montgomery Blvd as well as of the general area.

A video of the interview of Mr. Docherty by the police was shown to the jury. In it, Mr. Docherty said in effect that money lenders had been trying to shake him down, but he had apparently not spoken to the police about it.

The deceased, Tyson Weber of Kleinberg, was known socially to at least two police officers in that area, at least one of whom had snowmobiled with him.

Mr. Docherty had been in the process of purchasing The Flight Deck, a Mill Street pub, when he was being pressed for money. He told police in the interview that he was funding his purchase with a loan from TD Bank.

After Mr. Docherty left the pub, he said in the interview, he was unable to hold a job because of numerous phone calls from whoever was attempting to collect money.

At this stage of the trial, Superior Court Justice Bonnie Wein advised the jury that it could expect interruptions (while the court goes into voir dires for legal arguments).
